TERMS AND CONDITIONS OF SERVICE

1. INTRODUCTION AND ACCEPTANCE

1.1. These Terms and Conditions ("Terms") govern the relationship between Rustic Bambu Garden ("The Establishment," "We," "Us," or "Our") and any individual or entity ("Guest," "Client," "Customer," or "You") who visits, books accommodation, dines, or utilizes any facility at our premises.

1.2. By entering the premises, making a reservation, or utilizing our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1.3. Rustic Bambu Garden reserves the right to amend these Terms at any time without prior notice. Current terms are applicable at the time of usage or booking.

2. RESERVATIONS AND BOOKINGS

2.1. Confirmation: A reservation is considered provisional until a deposit of [e.g., 50%] of the total booking value is received. We reserve the right to release provisional bookings if the deposit is not received within [e.g., 24 hours].

2.2. Identification: In compliance with Kenyan law, all guests must present a valid National ID or Passport upon check-in. Copies may be retained for our records.

2.3. Group Bookings: Bookings for groups of [e.g., 10] or more persons may require a separate contract and a non-refundable deposit.

2.4. Rates: All rates are quoted in Kenya Shillings (KES) and are inclusive of applicable government taxes and levies unless stated otherwise. Rates are subject to change without notice, though confirmed bookings will be honored at the booked rate.

3. PAYMENT POLICY

3.1. Methods: We accept payments via Cash (KES/USD), M-Pesa, and major Credit/Debit Cards (Visa/Mastercard).

3.2. Settlement:

• Accommodation: The full balance of the room charge is payable upon check-in.

• Restaurant/Bar: All food and beverage bills must be settled immediately after service unless a "Room Charge" facility has been pre-authorized by management.

  3.3. Incidental Charges: Guests may be required to provide a credit card authorization or cash deposit upon check-in to cover incidental expenses (breakages, mini-bar, etc.).

4. CHECK-IN AND CHECK-OUT

4.1. Check-in Time: Check-in is from [e.g., 12:00 PM]. Early check-in is subject to availability and may attract an additional fee.

4.2. Check-out Time: Check-out is strictly by [e.g., 10:00 AM] on the day of departure.

4.3. Late Check-out:

• Check-out between [10:00 AM] and [4:00 PM] will attract a charge of 50% of the daily room rate.

• Check-out after [4:00 PM] will be charged at the full daily room rate.

  4.4. Luggage Storage: We may offer luggage storage for guests after check-out at our discretion. We accept no liability for loss or damage to stored luggage.

5. CANCELLATION AND REFUND POLICY

5.1. Cancellation requests must be made in writing (email or written letter).

5.2. Refund Tiers:

• Cancellations made > 14 days prior to arrival: Full refund of deposit (less transaction fees).

• Cancellations made 7–14 days prior to arrival: 50% of the deposit will be forfeited.

• Cancellations made < 7 days prior to arrival: 100% of the deposit will be forfeited.

• No-Shows: In the event of a "No-Show" (failure to arrive), the full cost of the booking will be charged.

  5.3. Early Departure: Guests checking out prior to their scheduled departure date are not entitled to a refund for the unused nights.

6. GUEST CONDUCT AND HOUSE RULES

6.1. Right of Admission: Rustic Bambu Garden reserves the Right of Admission. We may deny entry or evict any guest who behaves in a manner that is abusive, aggressive, intoxicated, or disruptive to other guests or staff, without refund.

6.2. Noise Policy: To ensure a peaceful environment for all, loud music and excessive noise are prohibited in accommodation areas after [e.g., 10:00 PM].

6.3. Smoking: Smoking is strictly prohibited inside hotel rooms and enclosed restaurant areas. Designated smoking zones are provided. A cleaning fee of [e.g., KES 5,000] will be charged for smoking in non-smoking rooms.

6.4. Illegal Substances: The use or possession of illegal drugs or substances on the premises is strictly prohibited and will result in immediate eviction and police involvement.

6.5. Pet Policy: Pets are [Allowed / Not Allowed] on the premises. [If allowed: Owners are fully responsible for their pets' behavior and hygiene].

7. USE OF GARDENS, POOL, AND FACILITIES

7.1. Swimming Pool (If applicable):

• Use of the pool is entirely at the guest's own risk.

• There is no lifeguard on duty.

• Children under the age of 12 must be accompanied by an adult at all times.

• Proper swimwear is mandatory.

  7.2. Garden & Nature: Rustic Bambu Garden prides itself on its natural environment. Guests are prohibited from cutting plants, picking flowers, or disturbing wildlife/birds within the compound.

8. RESTAURANT AND EVENTS

8.1. Outside Food & Drink: No food or beverages brought from outside (including alcohol) may be consumed on the premises without prior written consent from management ("Corkage fees" may apply).

8.2. Event Cleanup: For weddings or parties held in the gardens, all decor must be removed immediately after the event. The client is responsible for leaving the venue in a respectful condition.

9. LIABILITY AND INDEMNITY

9.1. Valuables: The Establishment accepts no liability for the loss of money, jewelry, or valuables kept in guest rooms or public areas. Guests are advised to keep valuables with them at all times or use available safe deposit facilities.

9.2. Parking: Vehicles are parked at the owner’s risk. Rustic Bambu Garden accepts no responsibility for theft or damage to vehicles or their contents.

9.3. Personal Injury: While we take all reasonable precautions, Rustic Bambu Garden is not liable for any injury, illness, or death sustained by any guest on the premises, unless caused by the proven negligence of the Establishment.

9.4. Indemnity: The Guest agrees to indemnify and hold Rustic Bambu Garden harmless against any claims, damages, costs, or expenses arising out of the Guest’s breach of these Terms.

10. DAMAGES AND PROPERTY

10.1. The Guest is responsible for any damage caused to the allocated room, furnishings, utensils, or hotel grounds by any act or omission of the Guest or their visitors.

10.2. We reserve the right to charge the Guest’s credit card or demand cash payment for the full cost of repairing or replacing damaged property.

10.3. Removal of hotel property (towels, pillows, decor, etc.) is considered theft and will be charged accordingly.

11. FORCE MAJEURE

11.1. Rustic Bambu Garden shall not be held liable for failure to perform its obligations if such failure is a result of Acts of God (including fire, flood, earthquake, storm, hurricane, or other natural disasters), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.

12. GOVERNING LAW

12.1. These Terms and Conditions shall be governed by and construed in accordance with the Laws of the Republic of Kenya.

12.2. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the Kenyan courts.
